Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Smartbull software platform ("Smartbull", "we", "us"). By creating an account, connecting a wallet, or otherwise using the service, you agree to these Terms.
1. Software-tool, not investment service
Smartbull provides software ("Software") only. We do not provide investment, financial, legal, tax or accounting advice. We are not a broker, dealer, exchange, custodian, fund, or investment adviser.
Nothing displayed in the Software constitutes a recommendation to buy, sell, or hold any asset. All trading decisions are made and executed by you, using your own exchange accounts and your own keys.
2. Non-custodial
Smartbull never holds user funds. The Software connects to exchanges you control via API keys that you provide.

- ✓You can revoke keys at any time on the exchange side
3. Eligibility & accounts
You must be at least 18 years old and legally able to enter contracts in your jurisdiction. You are responsible for maintaining the security of your wallet, account credentials, and exchange API keys.
Notify us immediately at security@smartbull.ai if you suspect unauthorized access.
4. Acceptable use
You agree not to:
- Use the Software to violate any law or exchange terms
- Attempt to manipulate markets (wash trading, spoofing, layering)
- Reverse engineer, scrape at high frequency, or interfere with the Software
- Resell or sub-license access without our written consent
- Attempt to exploit the Software, infrastructure, or other users

5. Subscriptions, billing & refunds
Paid plans renew automatically until cancelled. You may cancel at any time from /account; cancellation takes effect at the end of the current billing period.

6. Disclaimers & "as is"
Risk Warning
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE, OR THAT ANY STRATEGY WILL BE PROFITABLE.
CRYPTOCURRENCY TRADING INVOLVES SUBSTANTIAL RISK OF LOSS, INCLUDING TOTAL LOSS OF CAPITAL. PAST OR SIMULATED PERFORMANCE IS NOT A GUARANTEE OF FUTURE RESULTS.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SMARTBULL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR TRADING LOSSES.
Maximum liability cap
Fees paid in the last 12 months, or USD $100 — whichever is greater
8. Indemnification
You agree to defend, indemnify, and hold harmless Smartbull and its affiliates from any claim, loss, or expense (including legal fees) arising from your use of the Software in violation of these Terms, applicable law, exchange terms, or third-party rights.
9. Termination
You may stop using the Software at any time. We may suspend or terminate your access if you breach these Terms, abuse the platform, or if continued service would expose us to legal or security risk.
On termination we retain anonymized telemetry and audit logs as set out in our Privacy Policy.
10. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which Smartbull is incorporated, without regard to conflict-of-laws rules.
Disputes will be resolved by binding arbitration on an individual basis, unless local law gives you a non-waivable right to a court. The exact venue is disclosed in our Imprint.
11. Changes
We may update these Terms from time to time. Material changes will be notified at least 30 days in advance by email or in-product banner, and you will be required to expressly re-consent on next login.
